The Brady Handgun Violence Prevention Act, enacted in 1993, established controls on purchases of handguns and requires background checks on persons attempting to purchase handguns. Purchasers must be at least eighteen years of age and must be residents of the state in which they are making their puchase. In addition, the act probibits nine categories of persons from purchasing handguns:

  • persons under indictment for or have been convicted of a felony;
  • fugitives from justice;
  • perons dishonorably discharged from the military;
  • persons who have renounced their United States citizenship;
  • persons convicted of a misdemeanor crime of domestic violence;
  • persons subject to a restraining order;
  • unlawful users of or those addicted to a controlled substance;
  • persons adjudicated as mental defectives or committed to a mental institution;
  • illegal aliens.

     To identify potential data sources to identify mental committments, addicted substance abusers, illegal aliens, and persons who have been the subject of a domestic violence restraining order for addition to APSIN, per Brady Bill restrictions on purchase of firearms by these noncriminals.
